Terms of use
Version 4 · 31 October 2026
1. What BeMedi is
BeMedi (bemedi.app) is an intermediation platform owned by José García Ontiveros (details in the legal notice). It lets patients find health professionals and book appointments with them, and lets professionals and clinics manage their profile, schedule and appointments. BeMedi does not provide healthcare services, does not take part in the relationship between patient and professional, does not guarantee results and is not an emergency service: in an emergency, call your country’s emergency number (112 in the European Union).
2. Acceptance and versions
By using BeMedi you accept these terms, the privacy policy and the cookie policy. When you create an account or book, you expressly accept the current version (by ticking the corresponding box); we keep the date, the accepted version and the IP address as proof, and you can view them in “My account › Privacy”. The terms are permanently available on this page, can be saved and printed, and exist in the platform’s languages; in case of discrepancy the Spanish version prevails. We will publish each new version with its date; if the change is material, we will notify you by email at least 30 days in advance, and you may leave if you do not agree.
3. Accounts
You do not need an account to book. To keep your appointments, write reviews, join waiting lists or use the professional panel you need an account with accurate details and an email address that belongs to you. You are responsible for keeping your password safe and for what is done with your account; let us know if you suspect unauthorised use. We may suspend or close accounts that breach these terms, impersonate another person or put other users at risk, recording the reason. You can delete your account at any time from “My account › Privacy”.
4. Patients
- You book on your own behalf or on behalf of a minor or a person in your care; in that case give their name as the person attending and use your own contact details.
- You agree to attend the appointments you book or to cancel or change them with the notice set by each professional (shown when booking and in the appointment management link). Professionals may mark as “no-show” appointments you miss without notice.
- The prices shown are set by each professional, are indicative and may vary depending on the visit. BeMedi does not charge patients and takes no part in payment: you pay the professional directly under their conditions.
- Some professionals confirm appointments manually; until you receive the confirmation, the appointment is pending.
- The reason for the visit is optional: do not include detailed medical information. BeMedi is not a place for medical records.
5. Reviews
Only someone who has completed an appointment booked through BeMedi can write a review, once per appointment, from the link received by email. Reviews must be truthful, based on your experience, respectful and free of your own or other people’s health data and of third parties’ personal data. We review each one before publishing it and may decline to publish or remove it if it breaks these rules, contains insults, advertising, threats, data identifying third parties or signs that it does not correspond to a real appointment; the professional may reply once and may report a review for us to review it. Professionals cannot pay to modify, hide or delete reviews. By publishing a review you allow us to show it on the professional’s profile with the name you give when reviewing (it may be just your first name) while the profile is published, and to keep it anonymised if you delete your account.
6. Professionals and clinics
- You declare that you are of legal age and legally entitled to practise the stated profession in the country where you see patients, and you authorise us to check your identity, your license or registration number and your entitlement before publishing your profile and at any time afterwards. We may ask for additional documents and reject or withdraw a profile we cannot verify.
- You are responsible for the accuracy and currency of your profile, prices, schedules and availability; for attending booked appointments or cancelling them with as much notice to the patient as possible; for complying with the healthcare, ethical, tax and data protection rules that apply to you; and for the advertising of your services (no promises of results or misleading claims).
- You grant us a non-exclusive, free, worldwide licence to display on BeMedi, in search results and in platform communications the content of your profile (texts, photos, logos) while your account is active. You warrant that you are entitled to use that content and that the photos of your practice show no patients.
- A clinic is created by a professional, who is its administrator; professionals join only if they accept the invitation and may leave at any time. The administrator may manage the schedule, appointments, hours, services and profile of the members who have accepted.
- You process your patients’ data as controller; for the data you keep in BeMedi, BeMedi is your processor under the annex to these terms.
7. Plans and prices for professionals
During launch, the use of BeMedi by professionals and clinics is free. When we enable paid plans, prices will be shown on the “For professionals” page with taxes indicated, with no minimum term, and subscribing will require your express acceptance: you will be able to review and correct the details before confirming, we will email you the confirmation with the plan, the price and the version of the terms accepted within the following 24 hours, and we will archive the electronic contract document, which you can request at info@bemedi.app (arts. 27 and 28 Spanish LSSI). Price changes will be announced at least 30 days in advance. Patients never pay BeMedi.
8. Prohibited uses
It is not allowed to: create fake accounts or profiles or ones belonging to others; publish offensive, discriminatory or misleading content or content that infringes others’ rights; publish health data or personal data of third parties; book appointments with no intention to attend or in bulk; extract data from the platform automatically; attempt to access other people’s data or accounts; or use BeMedi for purposes other than those described. We may remove content and suspend accounts that break these rules.
9. Intellectual property
BeMedi’s software, design, trademarks and texts belong to its owner or licensors. Profiles, photos and reviews belong to those who publish them, who are responsible for them. Maps use data © OpenStreetMap contributors (ODbL licence) and cities come from GeoNames (CC BY 4.0).
10. Liability and availability
BeMedi is responsible for the operation of the platform with the diligence of an information society service provider, but is not a party to the care relationship: it is not liable for the quality, suitability or outcome of healthcare, for the accuracy of the data published by professionals, for the professional’s actual availability or for damages arising from the relationship between patient and professional, unless mandatory law provides otherwise. We strive to keep the service continuously available, with the interruptions needed for maintenance or due to causes beyond our control; we do not guarantee absolute availability. Nothing in these terms limits the rights granted to you by consumer law.
11. Duration and termination
These terms apply while you use BeMedi. You may stop using the platform and delete your account at any time. We may stop providing the service or close accounts for breach, with reasonable notice except in serious cases, keeping the data the law requires us to keep.
12. Governing law and claims
These terms are governed by Spanish law. If you are a consumer, you are also protected by the mandatory consumer protection rules of your country of residence and may bring claims before the courts of your domicile; you may also use the European online dispute resolution platform where available for this type of service. For professionals and clinics (business-to-business relationship), the parties submit to the courts of the domicile of BeMedi’s owner. Before any claim, write to info@bemedi.app: we will try to resolve it promptly.
Annex. Data processing agreement (professionals and clinics)
This annex governs, under article 28 GDPR, the processing that BeMedi (“processor”) carries out on behalf of the professional or clinic (“controller”) of the personal data of their patients that the controller enters or manages in BeMedi. It is accepted together with these terms when creating the professional account.
- Subject matter and duration. Hosting and processing the controller’s schedule: appointments (entered manually or booked by patients), patients’ contact details, short notes, blocks and opening hours, and sending service communications to patients on the controller’s behalf (confirmations, reminders, changes). It lasts while the professional account is active.
- Nature, purpose and data. Storage, consultation, modification, communication to the patient and erasure. Purpose: managing the controller’s schedule and appointments. Data: patients’ identification and contact data, appointment data (service, date, status) and, where given, the short reason, which may reveal health data. Data subjects: the controller’s patients.
- Processor’s obligations. To process the data only on the controller’s documented instructions (those resulting from the use of the platform’s features) and never for its own purposes; to ensure the confidentiality of the persons who access the data; to apply the security measures of article 32 GDPR described in the privacy policy (encryption in transit, role-based access control, action logging, database backups); to assist the controller in handling patients’ rights and, where relevant, impact assessments and prior consultations; to inform the controller without undue delay, and within 48 hours of becoming aware, of any security breach affecting their data, with the information needed to notify it; and to make available the information needed to demonstrate compliance, allowing reasonable audits upon written request.
- Sub-processors. The controller gives general authorisation for the sub-processors listed in the privacy policy (Cloudflare, Inc. for hosting and database; Resend, Inc. for email delivery), with whom BeMedi has contracts imposing the same obligations. BeMedi will give at least 30 days’ notice of any change or addition, and the controller may object by closing their account before it takes effect.
- International transfers. Only to the above sub-processors, with the safeguards described in the privacy policy (standard contractual clauses and, where applicable, the EU-US Data Privacy Framework), with the database stored in the European Union.
- Controller’s obligations. To inform their patients about the processing and have a legal basis for it (including the one applicable to health data); not to enter medical records in BeMedi or more data than needed to manage appointments; to handle their patients’ rights; and to use the platform in accordance with these terms.
- End of processing. When closing the account, the controller may export their appointments (CSV) beforehand. After the account is closed, BeMedi will stop processing the data on the controller’s behalf and will anonymise it within the periods stated in the privacy policy, keeping only what a legal obligation requires, blocked.
